Effective Date: January 1, 2024. These terms govern your access to the Coachvoice interactive coaching systems and virtual AI assistants.

1. Subject and Acceptance of Terms

These Terms of Service ("Agreement") constitute a legally binding contract between Coachvoice, a professional AI coaching provider based in Montreal, Quebec, and you, the user. By accessing our platform, website, or virtual assistant interfaces, you acknowledge that you have read, understood, and agree to be bound by these terms.

If you are using our services on behalf of a corporation or entity, you represent and warrant that you have the authority to bind such entity to these Terms. If you do not agree to these terms, you must immediately cease all use of our systems.

2. Description of Services

Our services are intended for professional development and informational purposes only. Coachvoice does not provide medical, psychological, or certified therapeutic advice.

3. Rules of Use and Prohibitions

Users of Coachvoice agree NOT to:

Technical Misuse

Reverse engineer, decompile, or attempt to extract the source code of our AI models or proprietary algorithms.

Content Violation

Input data that is defamatory, obscene, or violates the Intellectual Property rights of third parties.

Automation Abuse

Use "bots" or automated scripts to scrape data from our interface without express written permission.

Illegal Activity

Use the platform to facilitate any activity that violates Canadian federal or Quebec provincial law.

4. Intellectual Property

All rights, title, and interest in and to the Coachvoice systems, including but not limited to software, AI training data sets, UI/UX design, and research methodologies (the "Coachvoice IP"), are the exclusive property of Coachvoice and its licensors.

Users are granted a limited, non-exclusive, non-transferable license to access the platform. This license does not grant any ownership rights. Any feedback provided by users regarding the performance of our AI may be used by Coachvoice for system optimization without compensation.

5. Limitation of Liability and Disclaimer

Important Notice for Users in Quebec

To the maximum extent permitted by applicable law, including the Consumer Protection Act (Quebec), Coachvoice provides its services on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the AI interactions will meet specific coaching outcomes or that the system will be error-free.

Coachvoice shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or professional standing, arising out of your use of the virtual assistant systems.

6. Applicable Law and Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein.

As Coachvoice operates from Montreal, any disputes, claims, or legal proceedings arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the judicial district of Montreal.

For International Users: We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, the principles of the GDPR (Regulation (EU) 2016/679) for data subjects residing in the European Union.
